When do I need to apply for EAD and AP?

Hello friends,

I have a question about EAD and AP. I recently entered the country on Parole since my 485 application is pending (FBI Name check). When I entered in the country, they stamped Dec 26th 2007 on my I-94 (admitted till). My current EAD and AP both expire on 22nd March 2007.

I know that I have to apply 90 days prior to expiry for the new AP and EAD. Does the I-94 stamp of Dec 26th 2007 mean that I am permited to stay in the country and work in the country till Dec 26th 2007? Or do I need to apply for the new EAD and AP now in Jan 2007 (90 days prior to March 2007)?

Your I-94 doesn't establish the right to work in the US. :eek: That is based on your EAD. You will need to apply for the new EAD within the 90 days given as well as your AP?

After applying for my new EAD and AP within this 90 day period, what do I do if my EAD and AP do not come in before March 22nd 2007? Does that mean I potentially have to quit my job for that one week or two week period before which my new EAD and AP come in?

I am wondering why you need to apply for a new AP... :confused: Wouldn't your I-485 have been adjudicated before the summer? I mean, having your name stuck in the FBI name check is very common, but doesn't mean your AOS wouldn't be done in the long run.... Give yourself an opportunity to write to USCIS a letter each month inquiring about the status of your petition, so that they can work on clearing your name.... FBI... :rolleyes:

Unfortunately, when your EAD expires, you cannot continue working like all is well, you will need to have a renewal of your EAD to continue with your employer or will be in violation of the law.... :o I am sure u don't intend to violate the laws of the US.... :p

So, make sure you apply for your renewal as soon as it is feasible and the law permits you. Also, make an info pass and find out when will your AOS be done and inquire about renewal process of the EAD.... ;)
