When do I have to submit I-485 for my husband?

Hi guys, I have a question for you.

The university submitted my I-140 (outstanding professor or researcher) on 11/07/2003. I submitted my I-485 on 04/29/2004. I am in CSC. For both of these cases, I have not got any news.

I just got married on 09/19/2004. I am going to submit the I-485 for my husband. Since my husband is a F-1 student, so I want to submit his I-485 after I got my I-140 approved.

My question is: Do I have to submit his I-485 before my I-485 is approved? Or I can submit his I-485 anytime even I have already got my I-485 approved?

Wait for your I-140 approval. Yours is not concurrent filing. It is unlikely that your I-140 and I-485 will be approved at the same time.

Sounds good but if your husband want to work after student status in the very near future, you may submit I-485, EAD application forms now.

It is recommended that you submit your spouse I-485 application before your I-485 approval. After I-485 approval means after green card approval, it takes you years and so frustating wait for spouse green card approval.Good luck!

Thanks a lot for you reply. But somebody told me:

once your marriage is before your I-485 approved, you can submit your spouse's I-485 anytime. Somebody said, the key is when you got married not when you got your I-485 approved.

My marriage is before I-485 approved. Maybe it is different from the case that the marriage is after I-485 approved. If the marriage is after I-485 approved. It is like the case you mentioned, which is married to a green-card holder. That will take a long time for the spouse to get green card.

I know there are different point of views about this. I hope I can get a final conclusion here.

You can add spouse/children anytime to a PENDING I-485. The dates of marriage/birth are immaterial.
