When can we do H1-B extension?

My H1-B expires on 15-May-04. I filed I-140/I-485 concurrently on
01-Nov-02 at NSC and got the RD and ND.

If I change my employer say after Aug-03, and assume that I work with my new employer using EAD from Aug-03 through
Mar-2004.

At this time i.e during Mar-2004, if I realize that my green card approval will take more than 15-May-04, can my new employer apply for an H1-B extension before 15-May-04? (even though I worked with them on EAD since Aug-03)

Once you use your EAD to work for an employer you will no longer have the H1, so the question of extending H1 will not even arise. On the contrary if you just apply and get the EAD but not use it and continue working on H1 status(even after moving to a new company by applying a new h1 or an h1 transfer) you can extend your H1 when it is about expire.

Thanks for the reply. I have seen lot of people struggling to get EAD renewed in time as the rules keep changing. That's why, as soon as I can, I would prefer to extend H1 along with EAD.

So, that means, even though I started working with some employer on EAD, I can still renew my H1-B (which is from my previous employer) before its expiry date !!!

Please read my previous post carefully, I dont think you understood it properly. Once you start working on EAD, you will lose your H status, so no more extensions of any H1s after that.
