When can I leave my current job and still be in status?

Hello Folks,

I am in a situation where I need some information from an expert like you.

I am at present working at a University on H-1B visa (cap-exempt) for little over a year now. However, I have another offer in hand with H-1B (cap-subject) approval effective from Oct. 1, 2007 for a consulting job. I was lucky to get into the Master's quota this time and due to premium processing, I got my approval notice in May 2007.

I am at a stage where I want to quit my current University job. My question to you is, when can I leave my current job and still be in status? Can I leave as of today i.e. June 15, 2007? I am ready to loose income from now till October if I could remain in status. Some one said, you must be employed at least two months before the approval i.e. up to August 1 before I can leave my current job. What's the right answer? Can you tell?

First of all I am not a lawyer and I am not 100% sure about this but I think you can be without a job and still be in status for a month at the most.

In any case do NOT leave your current job unless you get a definitive answer from a lawyer, being out of status is the worst thing you can do on an H1.

So talk to your new firms lawyer,
