Hi,

I trying to understand when I can file my N-400. What makes me unsure is a re-entry permit I issued. I never stayed outside the US for more than 6 months and never had to present the re-entry permit.

Here is the complete time line. Please let me know when is the earliest I can file:

2/17/03 Resident Since (from Green card)
6/23/04 Re-entry permit issued
6/23/06 Re-entry permit expired
8/2/06 Permanently moved to SF, CA and left the country for only 6 days since.

I also accumulated about 6 weeks of residence in the US in the last five years and before I permanently moved here.

I also understand that you can file 3 months before you get the continuous presence condition satisfied. So that calculation gets me to a filing date of 9/2008.

Thanks for the help.

Guy,

You'll need to get more specific with your travel dates and other information before anyone can accurately answer your eligibility question.

i. Do you meet the minimum 30 month physical presence requirement?
ii. Do you have several back to back long (6 month) trips?
iii. What was the purpose of your long trips?
iv. Were you ever employed abroad during your time as an LPR?
v. How long have you been back in the US after you last long trip?
