I got my GC on 08/15/2002
I never left the country more than 2 months in total for vacation ( one week, two weekk at a time)
I filed for taxes as I was always working.

What is the time frame? When can I apply for the cship? Would you help?

Thanks..

PS: This question is for my friend Mose, and not for me.

Thanks.

What is it based on? If it is based on marriage to USC, he can apply now.
If it is not based on marriage to USC, then he can apply 90 days before he will reach his 5-year anniversary as a permanent resident. If he got his GC on 08/15/02, he will be eligible to apply on 05/18/07.

Is there anything in writing (i.e. from USCIS) saying that someone can apply 90 days before he will reach his 5-year anniversary?

Thanks!

Yeah, of course-) Here:

When Am I Eligible to Apply? You may apply for naturalization when you meet all the requirements to become a U.S. citizen. The section of the Guide called ''Who is Eligible forNaturalization'' and the Eligibility Worksheet found in the back of the Guide are tools to help you determine whether you are eligible to apply for naturalization. You should complete the Worksheet before filling outthis Form N-400 application. If you are applying based on five years as a Lawful Permanent Resident or based on three years as a Lawful Permanent Resident married to a U.S. citizen, you may apply for naturalization up to 90 days before you meet the ''continuous residence'' requirement. You must meet all other requirements at the time that you file your application with us.

This is from N-400ins.pdf from the USCIS web-site

Based on marriage: is it 3 years from the time one receives a green card or from the marriage date? thanks!

Look at my previous post.
It is 3 years minus 90 days, after you receive GC.
Look on you card, it should say "resident since....." That's the day.
You have to be perm. resident for 3 years minus 90 days, and be married to the same USC for 3 years minus 90 days.

per your earlier post, Married to the same USC for years - 90 days does not meet the "all other requirements at the time that you file your application" based on what the USCIS's instruction.

If the PR is applying the citizenship based on the marriage to USC, the applicant must have to marry with the same USC at least for 3 years prior he/she can file the application.

Well, of course. That was meant, I thought it's obvious. Not only that, applicant must mantain his/her continious residence for the past 3 years. Means, no long trips outside the country.
