Hi ALl,
Can someone tell me what is a background check and how it is different from a Name Check ?
My case was transferred to the Houston District Office for interview.
When i went there with an InfoPass appointment to enquire on the status of my case, i was told that my case is pending a Background Check.
I showed the officer the letter from the FBI clearing my name check.
However, he insisted that the Background check is different from the name check.

Does anyone know which agency is involved ?
Is it the same as the FBI name check ?

I have had 2 fingerprints ( 1 recently at the Houston District Office) and they have cleared.

Don't know what to do...
Thanks,
Anand

Background check

anand_houston,

I am not sure on this but have read somewhere that for 485 adjustment cases there is a CIA check that is done. This is probably the "back ground" check that they are referring to. Again I am not sure if this is how it works but am letting you know of what I read somewhere.

Maybe someone else might be able to provide more insight into this.

Hello Aanand,

Read this '485 Standard Procedure'

http://www.ilw.com/lawyers/seminars/august2002_citation2b.pdf

Specialy last chapters at Adujcant stage and "Inter Agency Record Checks" page 163 . and on page 88 ,120

--------------- Bkg-check

pg 88
"Establishing completeness of records may entail preparation of a request for
background check from an American consulate or embassy."

pg 120
After an I-485 application is consolidated, it should be linked to the FD-258
FBI fingerprint responses, rap sheets, fingerprint fees, and G-325A consular
background checks, already requested by File Maintenance.

After an I-485 application is consolidated, it should be linked to the FD-258

it seems bkg mean they send request to embassy for bkg-check.

------------- The Name Check pg 163

A name check with Division 4 of the FBI is initiated electronically by the
CLAIMS 3 receipt of the I-485. If no response is received within 60 days
after the C3 entry is made, the CAO may proceed with the I-485 adjudication.
Positive responses are sent to the local Law Enforcement Support Center who
will send the relating material within 48 hours of receipt or contact to the
Service Center POC holding the I-485 to ensure that adjudication of the I-485
is withheld until the third agency material is obtained and reviewed.

it seems Name check is FBI and Law inforcement records check

Don't worry Aanand jee, its normal case, becz they couldn't find ur Bkg from consulate thats why they are going for a very normal interview, to just see ur face :D . abs don't worry, go with smile :D .

Good Luck

Thanks for the response. Have a question/clarification

Hi Prince (and others as well),
Thanks for taking the time to give me a detailed response.
The problem is - i have NOT been scheduled for an interview.
The USCIS district office says the interview will be scheduled after the background check is complete.
So, what can i specifically do to get the USCIS to schedule the interview.
From your e-mail, i infer that the interview is conducted because they have not conducted a background check.
However, the USCIS says the interview will be conducted AFTER the background check.
I am from Bangalore. Should i contact the USCIS embassy in Madras and ask them to do a background check ?

Any help on this is much appreciated.
I plan to do an MBA this fall at University of Chicago - GSB.
If i don't get the interview by then, i will lose out on this opportunity.

Thanks,
Anand
