Dates are confusing, stating that priority date is based on I-140 filing date or Labor certification filing date if LC is required, but then went to state that the priority date does not attach until the underlying visa petition is approved.
What this means I dont know .
Maybe the lawsuite will clear up what dates means to everyone.
The priority date would only be consequential if the immigrant visa demand were to exceed the per country limit. Each month the Department of State issues a bulletin saying what is the priority date for each country or region. Fortunately for employment based visas those limits have not been reached lately so all countries are Current which means that an immigrant visa number is immidiately ready for everybody.
If for example in a certain month India's demand for visas exceeds the limits that would trigger a priority date for that country and only people with priority dates before that date would have an immigrant visa number ready.
