Hello,

Mine is a labour substitution case. The company's legal advisor who filed my case left the company a while back. Is there any way I can check my priority date? I have a copy of GC application package - looked at each and every document - but have'nt found the priority date? Please suggest.

Thanks

Have you seen the original and certified labor certification (ETA-750 I assume you refer to for a labor sub. case)? That may have the official filing date (which is the priority date) on it. On the bottom of the ETA-750B form (bottom right) there is a box for DOL use saying "date rec. DOL." That should be the space where the DOL fills in that they have officially received the LC. Thus, that date would seem to be the priority date, or very very close to it.

Thanks bjorn. I never got to see the original LC - when I was hired I was just given the job description of the LC case for which they were going to substitute my case. I filled out ETA-750, ETA-750B, I-140 and I-485 - but I did not not had to fill out any information pertaining to the original case. So how to get hold of the original filing date?

The original LC approval, regardless if it's a labor substitution case, must be submitted with the I-140 application. So, if your I-140 has been filed with the USCIS, someone at your company or the company lawyer must have seen that document and thus seen the priority date. I'm wondering why you had to fill out the ETA-750 and ETA-750B in a labor sub. case. If you are the beneficiary of a labor sub., the ETA-750 and ETA-750 are already done, all you have to do is the I-140 application and submit the ETA forms with that as the substitute beneficiary. Whomever filed the I-140 definitely had access to the sub. labor and the priority date. So, find out who filed the case. Get the name of a person and ask for copies of the files documents, if possible. If the lawyer left, a decent law firm and business would keep copies of everything since they do not want to put all their eggs in one basket (one lawyer).

I140 & PD

If your I-140 has been approved, get a copy of that. It has the PD somewhere on the upper left side.

My I-140 still has'nt been approved. But anyhow I managed to get the date when Original Case was filed from my Company's Human Resource Dept. Thanks everyone for the input.
