We all know that, we need to have EAD to work. I filed EAD renewal about 160 days before the expiration (current EAD expiring at end of August). Lets say if BCIS approves my application by 3rd week of august and it arrives sometime in september ?

Is it legal to work ?

Or do I need to get an iEAD ?

It should be fine, you need to have approval, it does not make difference you have physical EAD card it self or not. Sooner or latter you will be getting your EAD.
But you need to make sure that you are approved.

If ur ead is approved, you can work. Though new employer might want to see the card, and if you don't have it .. that might be a booboo

EAD approvals

Hi,

My EAD was expiring on May 29. I already had an iEAD from local district center. ONe month back I went to get an iEAD and they said no. When I stood my ground they said, come on May 28. I thought not to create too much of a scene. I came back and called IIO CSC and told her the scenario. She was not very cooperative. However I believe the message got through, and the EAD was approved on that same week (April last week). The ND date on my second perm. EAD was 3 rd week of Oct. I am yet to get my EAD. Two days back the status of my card changed to "...notice has been send, and 14 days ... ", which I believe, that the card has been printed. Well the crux of the story. If you get desparate, call the IIO directly and it might help .
Again I am not a lawyer, if you trust your lawyer (I mean it !!), then they might give you better options. Good luck .

Actually you CANNOT work unless you have the card in your hand. You usually get paid baised upon your I-9 form that you fill when you join a company. The I-9 clearly states that you have to be in status and prove it to an appropriate officer of the company who has to also see two forms of identification before you are put on the payroll.

Offcourse the scenario is different if you already have a job, I am not sure how that will work, but EAD is usually dated from the date of approval these days. So you might be able to work from the day it has been approved.
