What will happen to my GC processing when my company send me back to India.

Hi Guys,

Could some one tell me What will happen to my GC processing when my company send me back to India for 6 to 9 months of time.

I applied for GC through my company on may2001 and My Labor Certification is processing from NJ. few months back i came to bench. now my company decided to send me back to india for 6 to 9 months of time. I would like to know is this impact on my GC processing.

I would really appreciate your help on this one.

GC processing will continue, But

INS may question whether a permanent position is really available and (maybe) whether the company has the ability to pay the offered wage.

Your GC application is active and valid IF and Only IF

Your employer gurantees that there would be a job similar to that one advertised in form 750 ETA or as applied for Labor Certification.

Your employer gurantees to pay the salary stated while filing a labor application.

Your employer does follow up and pay all the money and fees required with and for INS and Lawyer.

The employer does offer the actual job to you when I 485 is applied.
