what visa?

can someone help me?

Im from New Zealand, and i have just married an American Citizen.
i am now quite confused about as to which Visa i am ment to be applying for?
i dont want to mess this up as i dont want to go back to NZ without my wife...

can someone tell me what visa i should be applying for?
and where can i go to get a application form?

i live in Chillicothe, Ohio if someone happens to know where i could go for some help.

if you are in US already and married an US Citizen, then apply the I-130/I-485 package to your local office. Once the application is accepted by BCIS, you are in "adjustment of status" period and you can only travle outside US using an advance Parole (form I-131). All these details are available on BCIS website.

a couple of other questions for anyone who can help...

i cannot find ANY visa forms of the ones SWaiting described on that site... and that makes me kinda nervous... haha...

Also, after my day of marriage, how long do i have to apply for my visa?

Please browse thru immigration.gov website carefully. You will find it under forms.

You need to send the following :
I-130,
I-485,
I-864
G-325 etc.

You can go thru the section where it says "How to apply for GC while in US"

If you are having such a hard time even finding the forms, then my suggestion is that you hire a lawyer for this. They can walk you each step...

Forms I-130 and I-485 are not visa forms. I-485 is a form for adjusting your status while in the U.S from a temporary, non-immigrant visitor to that of a permanent resident (green card holder). I-130 is a form filed by your spouse to petition the BCIS that the basis for immigrating to the U.S is marriage.

Along with these two forms, you also need to apply for an AP (Advanced Parole) document which enables you to travel into the U.S without a visa until your GC approval. And the EAD which allows you to work until your GC aproval.

Please note that filing out these forms is fairly involved (each one has multiple supporting forms). Recommend you take your time to fill each one out.
