Hi,

Just before two days i received biometric code 3 appointment for me and my wife in february 2005.My wife is in india studying in final year and My wife's studies are going to be over after 6 months and then she is planning to join me in usa. My lawyer is suggesting me that if i want to save money then i can request service center to reschedule my wife's biometric appointment after 6 months.He will write that request letter for me.

My questions are..

(1)my case is not consular processing.asking 6 months time for rescheduling biometric appointment can raise suspcision?

(2) being from India EB3 category priority date march 2003, it seems like couple of years to get my GC.Then why they are sending this biometrics code 3. isn't the biometric code 3 generally done after 485 is approved. Does this biometric notice mean that my case is almost done and they are gathering all the final remaining documents?

(3)My biggest dilema is that whether i should call my wife especially for this biometric appointment or not..seeing this retrogression mess i feel that there is not going to be any positive news for a while and I shouldn't waste any money and give trouble to my wife and family. But ever optimistic person inside me tells me that as i've already spent thousands of dollars and precious years of my life for GC then i better waste some more and call my wife. I don't know what to do.this gc struggle,frustration and wait has totally ruined my mental peace.

Time is running out for me and i've to make a decision.all the Guys who can put your feedbacks please help me out and give me your valuable suggestions.

Answer - Your reasoning is valid. Although FP and Bio appointments can be delayed, there is always a risk involved in this. The safest route is to go when they ask you to show up. This is what my lawyer says anyway. This does not mean that it cannot or should not be delayed. I am just sharing views that I have picked up in this forum and from my lawyer.

Answer - Lately the service centers have issuing Code 3 notices for a lot of people who have already completed Code 1 FPs. Code 3 is a rather new development and helps them to issue the GC without PP stamping. Receiving a code 3 notice while the case is retrogressed does not mean much. It is always good to get the Bio done because otherwise you will have to do it after approval. Do not read to much into it.

Answer - I understand your dilemma. The sad part is that this process is totally messed up and makes no sense. Any notice can be sent at any time and one is expected to show up. There is no regard for our time or our personal situation. This is the sad truth. To be on the safest side, call your wife here and get it done.

Why worry too much for money/saving ...

Companianship is the good reason to live the life.... I guess that's why we need money for......

Thanks for your feedbacks. I have decided to call my wife for this biometrics.

This whole process is a mess. Even they know that we are retorgressed for next several years,they keep us calling for this things as many time as they want! May be they want to show us that they are really working on something and may be we would get some positive news and continue being exploieted in the same job in the same salary for several years making our employers reacher! or see us in person and compare the negative And positive attitude in the immigrant's (or should i say Alien's) actions to do research about survival instinct of alien immigrants!!

well talking about positive things, only postive thing i see at this moment is that i will be able to be with my wife on valentines day!
