What takes priority PD or the RD

Folks,

Just wanted to ask all the gurus out there, does the Priority Date take priority over the Receipt date or vice versa.

To state an example:

PD: 01-JAN-1999 (EB3)
RD: 01-FEB-2005

Because PD is current will INS approve a GC or it will wait till RD (currently = 01-DEC-04 to reach 01-FEB-2005) to approve the GC.

Please note this not my case, I am just quoting a hypothetical scenario.

The reason for the question is, it has been more than 4months that RD hasnt changed. If this is going to be the trend, that means, though PD is current cases as late as 2000 are also not approved will not get approved till RD also gets current.

Please respond with your views.

In these days of retrogression RD has very little significance. Everything revolves around PD. A PD of 99 for EB3 is extremely lucky because anything after April 01 is in for a long wait.

the two are different and both must be current. I'm assuming the RD you mean is the receipt date for I-485. The RD becoming current depends on the movement of the processing date (Dec 1 '04), which depends on USCIS moving it's lazy ass. the PD becoming current depends on the line of people waiting in front of you. I think the processing date published (Dec 1 '04) is unreliable. They may be processing some before and some after. It's an opaque organization and opaqueness is always badnews for customers.
so neither Pd nor RD has priority. both are equal. Even if your PD is current, if you send your I485 app today, you'll wait for a year more.
 
PD and ND must be current to get I-485. PD is VISA quota for EB1/2/3 and ND is published by USCIS. Few days back PD was current and folks were waiting for the published ND to cross their ND. Now the days PD is floating somewhere in 2004 but PD has retrogressed to 1999. Either way we are stuck.

RD is just a week or two ahead of ND and carries no significance, as far as I know.

If Current PD > Your Labor Filing Date and Current ND > Your ND ( 485 filing date ) then expect the green card soon.
