My mother married my step-dad about 8 years ago right when the section 245-I was going on. She sent in the petition I-130 and it got approved but the lawyer that was sending the documents to immigration sent them late and immigration recieved the petition on May 1st of 2001 which made them too late for him to fall into the 245-I section. now he still doesnt have any papers the only thing we have is a letter saying that he is pending. He did have a deportation from when he got caught in Texas when he was entering the US he paid a fine but never showed up to court. All the lawyers we have seen tell us theres nothing we can do but wait for a reformation. we still dont give up the hope that we can do something since my mom is a US citizen and he has not gotten in any trouble after that. I am wondering is we should file another petition for him that wont have to do with the 245-I since he is definitely out since the papers reached USCIS too late or what should we do? should i file a petition for him also since when they got married i was still under 18 yrs old and i am a US citizen too?? I would greatly appeciate any feed back. Thank you in advance.
