I filed both NIW and OR for my I140.

My I-485 was filed before I-140 approval.

My I-485 was filed with the OR I-140 receipt. My NIW was approved. Can I use my NIW approval for filed I-485? what should I do?

Any information is highly appreciated.

Yes. You can use. It called I-140 substitution. My attorney suggested me to this, as my situation looks bad. Talk to your attorney.

Another information i need is was your second I-140 was CP option? Because you cannot have two I-140s for Adjustment of status as per my attorney.

Please verify.

Tammy2:

Thanks for your information. I did not choose CP. Actually My lawyer filed my I-485 with OR I -140 receipt, not the NIW. I do not know if I can replace that receipt with NIW receipt and approval notice.

Good luck to you.

You can use the approved I-140 to substitute for the other I-140 receipt filed with 485. Attorney will know how to frame the request. Alternatively, you can withdraw the existing 485 and apply for a new one with the approved I-140. Only drawback is that you would be paying the 485 filing fee again (and maybe related costs).
