What is the risk in going for Substitution?

:confused: Some says going with a substitution has a risk. Some says there is thousands of cases are getting processed on substitution and there should be no risk. I wonder what kind of risks involved in going for a substitution? I am currently in 8th year on my H1 and my employeer is not processing I-140. I am in need of finding a pre-approved labor.

there should be no risk if your paper work is clean (never out of status min 4 years graduate education or equivalent experience ..) . it all depends on the attorney .how they fight your case if it gets denied. bad attorneys are hand in glove with companies in delaying your case or not taking any action. Good Employers+Good Attorney+Good Candidate = cool GC :-)

I applied for an I-140 (Substitution) to nebraska service center on a premium processing. We received LIN # stating that they received the papers on 13th of Dec 2006. I am still waiting to hear from them.

Do you know how long they would take to decide on my case?
