What is the criterea...?

I always hear from INS about these 10,000 visas a year for asylees. What is the criterea for choosing those visas except time applied.

Every year, the INS publishes a cut off date for those asylee who would be given visa numbers (green cards). So the latest date so far is September 30th 1998. They are supposed to update this date within the near future. They projected that their new cut off date will be February 1st 1999. Note that these dates are the receipt dates for the I-485 applications. So in short, they give the 10000 visas on a first come first serve basis but they are backlogged in a ridiculous way to the extent that if someone to apply today for a green card, based on their granted asylum, they will have to wait at least 12 years to get it!

September 30 1978, 1998 is not the cut off date. This date corresponds to the "Date in Process" defined by INS as follows:

* Date in Process is the receipt date of the most recently received cases being processed. If your case was received by the NSC before this date and you have not received a notice of approval or denial, request for evidence or intent to deny, feel free to inquire about case status. If your case was not receipted prior to this date, please do not inquire as doing so may slow processing. Note: Fingerprint notices are generally issued 30-120 days after receipt of N-400 cases; 30-180 days after receipt for I-485 cases; and 30-60 days after receipt for I-821 and I-817

The cutoff date for FY 2002 has not been announced yet, and INS normaly does not announce it to the public. Instead they inform AILA of the cutoff date.
Last cutoff date reported by INS was January 16, 1998 as of September 30, 2001
