What is the citizenship status of our son?

Hello,

My wife and i became permanent residents in april 2004, but our son's case was not approved until over a year later, in may 2005. now, my wife and i are about to become eligible for applying for citizenship. my question is regarding my son, now 10 years old.

what are our options:

1. do we apply for his citizenship along with ours, even though it is not full five years for him?

2. do we apply for his citizenship right after we become citizens, even if it is before 5 years for him? or,.

3. do we have to wait a full five years for him, regardless of our own citizenship status?

Any help will be appreciated!

1. No, only people over 18 can apply for citizenship.
2. No, same as above.
3. No, he would need to wait until 18.

Now the good news :) He will automatically become a US citizen the day you and/or your wife naturalize. For this he would have to still be under 18 years of age, be physically in the US on his permanent resident (Green Card) status and be in the legal and physical custody of the parent that naturalizes. I am sure you are going to meet all this criteria. What you'll have to do is go to a post office with your child and your wife, a birth certificate for your son (I think it needs to be translated into English, you could check this in the passport instructions), your son's Green Card and your naturalization certificate or your wife's naturalization certificate and apply for a passport for your son. It is important that both you and your wife go to the post office, and the child also has to be present at the post office at the time of applying for the passport/s.

Alternatively once your son becomes an automatic citizen through the operation of law (Child Citizenship Act of 2000) you might choose to apply for a certificate of citizenship for your son by using form N-600. However, this costs some money and several months, so start with the passport. By the way, for extra citizenship proof you should apply for both passport book and passport card.
