Hi!
as we know oct-visa bulletin has broke all of us what are our option in case we have EAD & AP benifit with short validity H-B Visaexpiring 09/2006.PD is 07/2002


1.Should I apply CANADA Immigration??

2.Company isnot stable now use AC-21 & let wait & see what my luck is??

3.IF apply for canada & my H1-Expires Can I go to canada & come back with Advace Payroll??

4.How long it will take for CANADA Immigration?


5.Will it effect to my US Immigration i.e Pending I-485???

Canadian Immigration takes at least 9-12 months.
First off, take the CA points test and see how you fare. Realistically, it may take more efforts to immigrate to Canada and then search for a job there. You have to be prepared (monetarily and emotionally) to keep looking for jobs for 6 months before you give up there.
Comparatively regarding AC21, it is quite easy; you need very few documents to avail it. Jobs (IT and non-IT) are booming in the US, especially in large metros like NY, SF or LA. And it is not very difficult to get a stable job, now since most companies are looking for employers (rather than contractors). More over by getting in to a regular job you increase the chances of your career growth as compared to temping and contracting with a H1-B employer.
I-485 is rarely rejected, and in spite of the retrogression , you will be adjudicated one day !!

I am in a similar situation like ChanderJoshi. My PD is Sept 2002. So looking at the current Retrogression dates for EB2 , I can assume that at least 3years of delay. I used AC21 last year and quit my GC sponsoring employer. The employer withdrew my I-140 and USCIS cancelled my I-485 without sending me a NOID.
After filing a MTR my case was reopened and my EAD was reinstated. I was lucky to have switched on h1 transfer and could continue to work for the new employer which unfortunately is also a "dalal" company. I have one year left on h1 .

Now seeing the EB2 retrogression , I am thinking of making another switch but I am scared to come on EAD . What if my present employer informs USCIS that I have left his company and then USCIS again cancels my I-485?

The worst part of my journey was that I had responded to the RFE on August 2005 and was awaiting approval when this retrogression disaster happened.

I have a question on your AC-21. Did your I-140 approved when you switched the employer? How long was your I-140/I-485 pending before you switch?

I am also thinking of switching to new employer. Will there be any issues with my application. I have all my details in signature.

Now a days Canadian immigration can take upto 2 years (assuming you meet all the requirements), it took me one year when I applied in Nov 2003, after that there was a flood of new applicants.
As cnr states... just having Candian PR is not enough, you have to be prepared...
