What is Priority Date (PD)??

Hi Friends,

I want to know some information about PD (Priority Date) floated around by people in GC Process. What is that date mean by? How is that going to impact the GC Process?

In my case my RD is 12/4/2002 and ND 1/14/2003.

RD - 12/4/2002
ND - 1/14/2003
EAD - 2/25/2003
140 FP - 1/28/2003

In rupnet though i didn't provide the PD it is showing 1/1/2000. What is that date? I filed my Labour in 5/2001.

I want some clarity on PD? Will that impact on GC Processing in any stage?

Priority date is the one when you filed your labor. From your posting it seems it is 5/2001.

When USCIS posts the latest date of accepting the I485 application, it always refers to your priority date and it is based on the EB category. For eg. EB2's 485 application acceptance date is different from EB3. If you send your 485 prior to the USCIS's priority dates, your application can be sent back to you.

Also, when it comes to approval, your priority date plays major role. Say, Tom and you filed 485 on the same date. Your priority date is 5/2001 and Tom's is 6/2001. USCIS will consider yours first and then only Tom's.

So friend as per your explaination what i understood is that priority date is same as the date when labour is filed by a person to BCIS (not the date BCIS received the labour application). Then the PD is used in 485 processing in such a way that if there are two applications with same RD and category then the person with earlier PD will be considered for processing.

Correct me if i am wrong in my explaination.


If this correct then where do i get the information what priority date is being used by servicing center in processing the 485 application for each category?

Actually, if I am correct, the PD is the date that USCIS is assigning to you. And mostly it revolves around the date that you sent. You are right about how the PD plays role when 485 processing starts with the same RD.

As Chandra explained to you, let me add some more:

Your PD is the date your Labor Certificate application was filed, not to USCIS but to state labor department. its role is minimum as ALL employment categories are current for all countries (EB1, EB2, Eb3, etc). If they were not current (C) then one should wait until his/her PD becomes current and then apply for I-140. Nowadays one can do concurrent (I-140 plus I-485, EAD, AP). Its only role is when two people applied on the same day, then the one with earlier PD gets precedence over the other. No big deal since both applied on the same day..given the backlogs also.

Thanks Cinta for pointing out, that by mistake I mentioned it as USCIS for the labor certification.

However, I-140 can be applied immediately after the labor is approved. Only 485 you have to wait until the PD becomes current. Right? I am not sure how concurrent I140 and I485 works if the PD is not current.
 
All dates are now irrelevant..... AS BCIS does not go by dates anymore....they go by their moods or anything other than dates.

Yes, correction. If the PD is not current, then one can apply for I-140 only or wait until current and do concurrent. Under the current climate, either route looks a long way..
 
Thanks for all shedding their light regarding the PD. Regarding the approval i already completed 11 months and closing to 12 months. If it is roughly taking 20-22 months for 485 approval i may have to wait for 10 more months. Hoping approval by coming August - October timeframe. Will be good if it is approved even before.
 
Priority Dates will be available only when your I-140 is approved.

But with present rules its hadly playing anyrole...its negligible now...

How does it work in case of Lobor substitute Case.
Where Can I find the priority date in such a case
