What is pre-approved Labor approval

Hi,

I am currently in US on a B1 visa.

I heard from a consultant that he has a pre-approved Labor permit and offerred me a job. Is that possible to work on that approved labor permit still i get my H1 visa this october?

What exactly is this pre-approved labor permit?

A Labor Approval (LC) is the first step in the process for Green Card. The employer makes an application to the Dept. of Labor stating that he has a position open and he is not able to fill that with any locally available candidates. In the application the employer proposes the name of a current employee of his (working on a H1) and offers him this permanent postion.

Based on this application and the qualification of the candidate the DOL approves the LC. Based on this approved LC the an Immigrant Visa petition is filed with the INS (This is called the I-140 process) . Once the I-140 is approved the candidate either applies for Adjudication of Status(AOS) or 485 process OR the Consulate Process (CP).

So, in your case you are being offered an LC which was probably approved for a different candidate. The substitution of the candidate is possible provided your qualifications and experience match that of the candidate. However I am not sure you can directly start working for his without first getting a H1. LC is as I said above is a step in the GC and not a direct permit to work.
