what is packet 3 and packet 4 ?

Hello all,
My I-140 was approved on Mar 25,2002. when can i expect an interview in the chennai consulate, approximate time frame?

also, what is packet 3 and packet 4 ?
can somebody tell me ?

by the way has your case transfered to NVC from INS...?...it will happen only if you opted for CP in your I-140 petition...?...post your case details, so that I can help you further.

I did not opt for CP during 140,but will be going for CP, if I opted now, how long will it take ,
this is the message which I got from my attorney :

Your document has already been sent to the Department of State National Visa Center. The NVC will process your case that need consular action and will forward the approved petition to the consulate. It will take about 90 days for the NVC to send the packet for CP process. If you have decided the CP process, we need to wait for the packet.

Your I-140 was approved on March 25, 2002. After approval of the I-140, the
INS sends an copy of the approved petition to the National Visa Center
(within 2-3 months usually). Then NVC sends the approved petition to US
Consulate chosen on the application (Chennai, India) and sends the Packet
III to us (2-3 months).

NVC probably just received your I-140 approval notice and should be sending
us the packet III within the next 2 months. We will then have to complete
the various documents and send everything to the U.S. Consulate in Chennai,
India. After receiving the Packet III, the US Consulate will review the case
and schedule you for an interview (usually within 2-3 months).

We will contact you as soon as we receive the Packet III.

Do you have a copy of your I140 approval notice ? If so check it. It will tell you if the INS has retained it expecting you to file 485 or if they have sent it to the NVC.

If they have retained it and if you still want to do CP, you will have to file I-824 to get it transferred to the NVC. If your consulate is other than Chennai, you will be able to use the 824 receipt and do AC-140. If you belong to Chennai, you have to wait until the INS acts on your 824 and transfers your case to the NVC and go thru all the NVC steps before you can complete your CP.
 
My I-140 was approved on Mar-26th-2002 from VSC and INS has transfered

my case to NVC on Apr-6th...usually INS takes 2-weeks to transfer the case to NVC....my strong suggestion to you would be calling NVC at 603-334-0700 and enter the following options 2,2,3,1(Enter I-140 receipt#) then follow the instruction from there...by the way ones you get the P-III you can\'t send P-III directly to chennai instead you need to send p-III back to NVC, once they review your case they would send your P-III to chennai...

What is P-III:

P-III is nothing but an DS-230 Part-I application. you just need to fill this one for each person & send it back to NVC by attaching $260.00 per person.

What is P-4:
---------------

P-4 is just the appointment for the interview & instructions from chennai consulate to you...you can download p-4 from the web.

he sent the following to me :

We did not send anything yet because we have to wait for the National Visa Center to send us the Packet III. NVC will give us the address where they want us to return the packet III. They also will send us a return envelope.

what is the approxmate time for my interview according to you? My guess is Sept \'02, what do u think?

If you did not opt for CP at the time of filing I-140 don\'t you have to file I-824 . Also,
do you know that chennai consulate does not accept attorney certified I-140. That\'s what i have been told. Which service center do you fall under. I hope it is not texas .

Yes...your attorney is correct....but NVC will respond to your case only if

NVC received your case from INS, but INS transferes the case to NVC only if you have choosen CP instead of AOS in your I-140 application or if you had filed for I-824 since your I-140 has been approved.

you need to do the following things in order to bring your case on track.

1>.Contact your attorney and ask him which option(CP,AOS) has he choosen in your I-140 application.

2>.If your attorney replies that he has opted for CP, then you need to need to talk to NVC asap.

3>.If your attroney replies that he has opted for AOS, then you need to file I-824 in order to go for CP.

there is no meaning at all in waiting for P-III from NVC with out going thru either step-2 or step-3.

If you are sure that your attorney has choosen CP in the I-140 petition...

& your I-140 was approved, then you better talk to NVC...2-3 months is very unusual where as 2-3 weeks in usual...so talk to NVC operator....as I told you earlier my case has been approved on Mar-26-2002 & NVC received my case from INS on Apr-6th...

603-334-0700 enter 2,2,3,1(Enter I-140 Case#) and then follow the

instructions from there on...

Note: since you are calling from INDIA, you better not wait for automessages before you enter the sequence of numbers ie.,2,2,3,1(...) stuff.

Since you dont have your NVC case number, you will need your 140\'s EAC (or SRC/LIN/WAC) num. If you dont have that, then its possible that the NVC operator can search for you by name and employer information, but it could take longer.

Also, call the NVC around 8:05 AM EST (thats about 5:35 PM IST, M-F). IMHO, thats when I\'ve experienced the shortest waiting times, sometimes even getting through to an operator without first listening to the AVM.
