What is my status?

Can anyone tell me my status? Here is my case,
In June 2003 BCIS denied my I-485 after they came to now about layoff. I had completed two years after filing I-485 and I-140 was approved three years ago. Employer did not ask BCIS to revoke I-140 but informed about the layoff. I filed for Motion to Reopen the case (MTR or MOTIC). They replied in a month (in July) that they are taking 6 months to process such requests.

Meanwhile, in August 2003, much awaited memo from BCIS was issued. (Had this been issued earlier, I would not have been in soup).

1. Am I out of status?
2. Some say that I have 180 days after denial to be out of status?
3. What happens after 180 days? Should I leave and wait for the decision from BCIS outside?
4. What are my options?

I am still tensed.

After you filed your MTR, you were back to AOS. You are AOS until they approve or deny your MTR.

1. My EAD date is still valid but my AP has expired. My lawyer told me not to renew for AP as it will be denied. He says, technically my EAD and AP both are invalid. What to do?

2. With the memo released on AC21 in August 03, what are my chances of getting GC approved?

Please help.
