Hi,
My lawyer is planning to send my labor certification documents to INS this week. I am not clear on what is the 'submission date' means. Is this the date on which we send or INS receive our mail? Or is that the date on which INS open our case. What I precisely want to know is, will my case be considered as 2004 or 2005 applied?

Thanks in advance.

First Question, Why your Lawyer is planning to send LC documents to "INS" ??? INS does not process the LC.

DO You mean to say You have approved Labor & you are filing I-140/485 ?? If yes, then the date INS(now USCIS) receives your Documents (Receipt Date) is the date of your application. SO if they receive your I-140/485 papers before 31st Dec, its 2004 case otherwise 2005.

It is for Labor Certification. I am not sure it is for INS or ... But my question was to find out what is the filing date for Labor Certification? Is it day on which documents reached to them or the day on which they open it?

The day SWA/SESA enter your file in to their records (about couple of days after they receive the documents from you)
