What is I-730 processing up to now?

the date on uscis website is not accuate. The date is damn slow :rolleyes:
 
Something’s going on with I 730 petitions. At April they worked on July or August 02 applications. Now in December 03 they work at September 02 applications. Slow from some reason.

I-730 Processing times

Our Notice of Action is dated 11/08/02. According to our current on-line case staus, it's taking NSC 400-430 days to process this kind of case. I have a feeling that these terms will be extended again.

In May of 2003 I was able to abtain the following information:
1) My case was placed into the "working section" (whatever that means. I guess these are the cases actually awaiting to be processed)
2) NSC has been behind their processing time log and during May-September most of the NSC staff was working on I-730 cases. This is when I-730 processing times were actually moving.

Since the end of September '03 the date of the case being currently processed doesn't seem to change.

I'm very curious to hear if anyone who applied in October - November of 2003 has received anything from NSC.

I also have a couple of questions:
1). Can I-730 be denied and why?
2). I'm currently in the US. Would I need to go an inteview and if so, does it usually take place locally or would we have to go to NSC?
2). My husband as a primary asylee had to reside here for at least one yr from the day he was granted asylum in order to apply for adjustment of status to permanent. We want to wait until I get my status and file I-485 together. Do I have to wait for another year once I'm granted my derevative status to be eligible to file I-485 or not?

I would like to hear from anyone who is currently in the US waiting for I-730 decision or has a similar experience.
Will appreciate your replies.
 
Well, everything is slow at the CIS and I do not think any outsiders really know what is going on. A complete background check is probably a major factor. All I can suggest is patience.

As to your questions,

Of course an I-730 can be denied, just like all other immigration applications can be denied if you do not meet the requirements for the benefit sought.

If there is an interview, it will be local.

You have to wait for one full year from the date of your I-730 approval to apply for adjustment of status. I strongly suggest that your husband to file the application himself as soon as he is eligible--since the whole process is taking so darn long.
 
i730 is slowing down... please post your approval date guys.

nowdays, people have to wait about a year for a derivative status
later on, people have to wait more than few years for a derivative status..

The same thing just happened to Adjustment Of Status cases..

According to my lawyer, there's no need to go for a interview since you are in the U.S. already.
He told me there's no need for fingerprint too.
you will get an i730 approval letter when you got approved.

As I was looking through the forum threads, you made an impression of a very intelligent person with a great deal of knowledge about political asylum.
I thought I would be automatically eligible to apply as a spouse of asylee eligible to apply for I-485 regardless of how long it’s been since I was granted status.
Also what about eligibility under (b) category (“my spouse or parent applied for adjustment of status or was granted lawful permanent residence in an immigrant visa category that allows derivative status for spouse and children”)?

The law is very clear--one must spend one year in asylum status before applying for green card.

The derivative provisions you cited only apply to certain immigrant visas under section 201 and 202, INA., not the asylum process.
 
damn. last few months they are processing sept 30, 02 and now thay are doing sept 20, 02... going backward now!!
what the hell!
