What if you exercise AC-21 without I-140 approval offcourse after 6 monhts.
1) if a RFEis issued for ability to pay , would it be replied on basis of previous company finacial status or new company. A Lawyer told me that it has to be on financial status of previous company, this is weird, but is it TRUE? I dont see any reason for this
This is what he says "Whoever filed your labor and I-140 shall the responsibility to prove its ability to pay from the date it filed your labor to the date you changed your job. So, it is very important to ask that company about their tax return. If no good, you will get your 140 denial."
