What if Unemployed after filing for CP?

Hi,

My situation is this. Employer is willing to offer me the current job till I apply for the I-140 and CP. What if (1) remain on unpaid leave (bench) after filing for CP till the interview or (2) if I loose the job before my interview materializes.

Appreciate any insight.

AnsweR: This is illegal both for you and your employer. This is not an option.

Answer: You would need to start GC from scratch.

Recommendation: File I-140 with 485 concurrent and convince your employer to get you on a project for at least 180 days from the date of receipt of 485 and then you can use AC21 and be relatively safe.
