What if some one want Indian Citizen Citizenship Back?

Hi,
One of my friend who is Us Citizen, He want to know how to get back Indian Citizenship again giving up the Us Citizenship. He has house in us and business here and want to maintain that but he want to get back Indian Citizenship and also want to get back Green Card. Is that possible? In future he want to live in India.He just want to know for the future if he intends to do so. Giving Us Citizenship also means He can't live in the Us or he must reapply for Green Card like everyone do?
 
Well technically your friend does not need to give up the US Citizenship to move and live back in India. Your friend can get an OCI (Overseas Citizen of India) and then just live in India and continue to maintain the US Citizenship.

To get back the Indian Citizenship, you have to live in India with OCI / PIO for a year and then you are able to renounce the US Citizenship and get back Indian. BUT that would mean he would need to start the entire GC process again ....

I think I saw a posting from you earlier about filing for citizenship after being away from the US for 11 months or so. I looked hard to find the posting but no luck. You mind answering it here or do you want me to send a pm on it (if I can figure out how).

Hi GC_TRAP,

Yes I had posted about filing for Citizenship after being away for 11 months. Actually my wife was out of the country for 11 months in 2008. However we filed for her Citizenship and she has completed her interview and is waiting for her oath letter. We did not have any problems with her application in regards to the 11 months as I was here during that period and her name was also on our mortgage. I submitted a copy of the mortgage papers with her application and everything went well.

In fact the IO at her interview did not even ask her any questions about the 11 months. Hope that answers your question. PM me if you have any specific questions.

He has to get OCI / PIO, then wait 5 - 7 years (depending on OCI and PIO) and within that period stay in India at least one year, and then he can apply for citizenship.

Getting GC .. same process as everyone else. If the wife is and remains a USC, that will be the easiest.

But you realize the total time in this exercise ... will be years.

Knowing the motivation for this will help as there might be better solutions.
