Hi guys,

I am currently on EAD and planning to travel to India on my AP.
My GC is just a month or so away from approval(atleast I am hoping).

So what if my GC gets approved while I am away in India. Can I still enter into the country with my EAD and AP. Or will I get to face any other complications.

Please help me as I am planning to visit India later this month.

thank you all for all ur inputs

No problem at all.

When I came back home last year after three-week trip to my home country, I found letters from INS. Initially I thought :"Oh, we got RFEs. But how can we get RFEs for whole family?". After we opened the letters, we happily found those were Approval Notices. Our cases were approved while we were outside the country.

When we passed the immigration control with AP, we were not given an order to appeal in the local INS for stamping as said by other people. We were given a new I-94 card with one year expiration date (not D/S). I do not know what we should not if my I-485 did not get approved in one year. The Officer only asked one question: "Are you still working with the same employer?". I still feel strange why the Officer did not know our cases had been approved from his computer screen.

Have a good trip.

vijaynathg,

One of my friend's lawyer advised him not to travel outside the country if expecting the GC in that time period. (His wife was waiting for the approval where as his was approved)

The foolowing is from the site http://www.murthy.com/ukpbadpl.html

Another common situation, not specifically mentioned in the INS memo but previously authorized in INS instructions, is if the I-485 application is approved after the applicant's departure from the U.S. In that circumstance, it is typical to grant deferred inspection, so that the person can go to the local INS office and obtain the permanent residency stamp in the passport
