What if I do have a FBI record?

Ok, here is something that has bugged me for a while now. I filed my N-400 in Feb '05, had an interview in Aug. '05, was told that my name check has been pending since Mar. '05. So, it's been over 120 days since my interview, but....

Back in 2000, I was called in by the local FBI office for a friendly chat about my possible ties to the Russian mob. Since I left Russia when I was 8 and the last time I was there I was 12 and in 2000 I was 23, obviously my ties to the Russian mob were about as strong as those of the FBI agent who was sitting across from me. He had around 6 pages of questions to ask and I think he skipped close to 90% of them because they simply didn't apply to me. The other 10% I answered with pretty much "I have no idea". During the conversation, I found out that they had tracked me for 4 years after the FBI agent walked into the university in 1996 and asked their public safety office if they had any foreigners working for them. Lucky me, I was working for them making $5/hour entering parking tickets in their computer and walking around the campus making sure that it is safe. So, they started tracking me.

This being said, I suspect they got a file on me no matter how irrelevant and bogus the infromation about me is. I think I'll get my FOIPA letter and it will say "You are gonna be featured as king of spades in the next issue of the most wanted terrorists deck of cards" Kidding about the deck of cards, but if I do have a file with them... what would be my options? I'm pretty sure that will prevent me from sueing them as much as I want to. What would I be able to do?!?

First of all having a file doesn't mean anything, depends what's in the file. Secondly, the way you presented the case, you don't have anything to worry about and still you can sue them since they needed such a long time to figure-out what formula did you suck when you were a babby back in Russia. But first go for FOIPA and worry about your file when and if you find that you really have one, until then think and act like you don't have one. Is good for your mental health. :)
