What if I-485 approved when out of US?

folks,

i have a RFE pending received on Nov 12th. Attorney is lookin into it. I will be travelling out of the country for most of December. I have a H1B valid till June next year.

What if USCIS receives the response to RFE and approves my I-485 when i am out of the country, Can i still re-enter on H1B? or is that not possible?

folks - please share ur thoughts, 've asked the same question from my attorney - he's out of the office for this week and 'm scheduled to leave 2 weeks from now...any of ur responses shall be helpful.

Yes, you can use your valid H1 visa or AP - whatever available for you.

Search forum. There were plenty of Q&A in past regarding this issue.

I have poured over many pages in this forum since I am in the same boat as yourself. The facts are that if your I 485 is approved then in immediately negates your H1bvisa since your status now is an immigrant. You WILL need an advance parole to re-enter the country. You WILL not have any problem at the airport security check on your return as long as you have a valid advance parole. If in doubt search the forum using the key words advance parole and travel abroad.
