I-140 approved, I-485 pending for 360 days.

What happens if current employer lay off and attempt to 'withdraw' the approved I-140 ?
Does it mean your I-485 gets denied ?

I know that you have invoked AC-21, you would be OK. In this case imagine that AC21 has not been invoked yet.

Difficult to say. Employers get too greedy and do this.

if the employer uses this labor/140 to someone else after firing, this is perfect receipe that will cook them to jail.

I don't see any law/memo that could "cook them to jail". In fact, it's legal to do this.

Agree .... in fact thats why AC21 is in place .. to protect employer as well as employee.

Hi Cheekoo,

After the tough time you have had, i think you are pretty close to getting the final approval.Wait for the next Update and if there is no Name check hassle you should be through in a couple of months.

Regards.
