Yesterday hopes got alive and also curiosity of what next. Well my EB3 PD is 12/2002 so it is current. I have opted for consular processing. My current H1B is valid till Dec 2009 and my wife's H1B is valid till May 2009. My question is say if we are got real unlucky and CP is denied, can we still come back on H1B here and file for AOS. Remember we don't have H1B stamped based on what we have now. The current H1B has expried, but we both hold approved H1B.
