Judging by all of the 2001 approvals these days, does anyone know for sure what happens to someone who gets approved while they are traveling on AP and temporarily outside the U.S.???

One lawyer told me you get "deferred inspection". Another lawyer told me you get in on AP as usual and you go to local INS office for stamping. A third lawyer told me you get your LPR stamp at POE. Who is correct???

From previous posts by people who were in this situation I remember that most likely the officer at the POE will be able to see in their system that the I485 is approved. He would stamp the AP for only 30 days and in this period you should get your approval letter and go for passport stamping.

hi

Mine and my wife GC is approved on 20th Nov'03, but my wife was in India during that time, she came to US on 01-Dec-03 thru Newark airport, she did not have any problem, as usual they checked everthing stamped the I-94. She is yet to go for GC stamping at the local INS office.

Thank you so much, Texas 01!! Do you mean to tell me that they treated you exactly the same so that you use AP if your I-485 is not already approved, and you still use your AP if your I-485 is approved so there is no difference whatsoever?? Thank you!!

I hope you know the AP process at the POE, what they normally do is if a person is in AP, they will send the person to green room(i think INS people) there they will check about the AP, stamp the I-94( this will take about one hr).

My wife do not know, what they cheked, they just called after 1/2-1 hr gave her passport with I-94 stamped along with AP papers.
