What if 140 denied and u did not apply for 7th yr extension

Hi there Gurus
MY i140 and 485 went to NSC in june 0f 2004. Nothing is approved as of yet
I did not used my EAD
My 6 year limit of H1 is coming to end.
I have'nt plan to apply for 7th year extension.(My RIR labour process started in 2001)
What if I 140 gets denied, and I don't have H1.
Should I MUST get the 7th year extension ?


Any suggestions are highly appreciated
 
If your 140 is denied, then your 485, EAD, AP will all be cancelled and you have to stop working if this happens after your 6 years of H1. You cant use them until you appeal and they open the case again.
My sincere advice, go ahead and apply the 7th year H1 based on your pending 140. Waiting for your 140/485 approval on your EAD is not a definite doom, but not worth the trouble if any! Good Luck.
