Guys, I don't mean to be pessimistic. I just want to know the law. Everybody is talking about I-485 approval, but nobody seems to be talking about what happens if I-485 is denied. So, I am asking these questions. please don't yell at me.
1. What happens when somebody's i-485 is denied for what ever reason?
2. At this point does the USCIS consider that person as Illegal Alien and arrest him? Because, I am reading lot of stories of people being arrested by USCIS while entering the country on AP.
3. Does USCIS give any time frame for that person to leave the country?
4. Agreed that he can file Motion to re-open, but what happens even if this is also failed? how much time he gets to leave the country?
5. Does that person fall "out of status" as soon as his I-485 is denied?
I basically wants to know whether the USCIS gives time for the person to leave voluntarily or they will arrest the person and deport? Scary right?
Guru's any info on this is appreciated.
