What happens when cut-off dates in Visa Bulletin regress?

Hi,

I just noticed in the Visa Bulletin from June that cut-off date for category 2A in family categories regressed from 01-Mar-2002 in May to 22-Apr-2001. That's almost one year! My wife's priority date is in February 2002 and she applied for I-485 at the beginning of April. She got a receipt notice, but no FP notice until now. Will her application continue to be processed, put on "back-burner", or outright denied?

Sorry to see that she is being caught up in retrogession, but the fact is: she will NOT get her greencard until her priority date is current if she have'nt done her interview as yet. Think this bad, wait until next month when the next visa bulletin comes out...further retrogression!
 
Thanks for the quick reply. Will she at least be able to get an EAD while I-485 is pending? The LUD on both I-485 and I-765 changed last time on 4/22.

Or hopefully I'll get my citizenship...
 
I'd like to wish you luck on getting your citizenship.That's the only way out for you to finnish with USCIS.Atleast you are together in the USA but what about those who are apart and no chance of getting a citzenship for now.You are indeed lucky to be together.
 
hi. i am new to this. got my approval of petition. it is now going to nvc to see which consulate gets it. my petition is of unmarried child of us citizen. right now i am still current when it comes to the dates. so is possible that they push back the dates and hold me out.

while a green card would be good, could i least be able to legally work?
 
I really don't know if you can work while a green card application is pending.As you say your date is current but should a retrogression occurs in your category then yes you will have to wait until your PD becomes current again before you can have your visa interview.

Well, if your priority date is before April 22, 2002, then you are current will be able to get a interview for the necessary consulate if any visa number is available for you. If you filed after April 22, 2002 I think the waiting is going to be longer. As soon as get your immigrant visa and arrive in the U.S., in a few weeks your greecard will be mailed to you.

My only concern is how comes your file is just coming from the USCIS to the NVC and you are current, unless you were upgrading from F2B. Because all I know is that all cases filed in F1 umarried Sons and Daughters up to early 2005 is at the NVC. maybe they did overlook yours, if you are not indeed upgrading. But check the priority date again.
 
yes, it is an upgrade. so got a letter saying that the petition got approval and was going to nvc. they will let me know in 90 days or something. i am currently in the country. this is part of the 245i.

so i have to wait for nvc before i can do anything? can i file a i-485? it does say they will be contacting me. how? if they don't know my address? anyway, what is my next step assuming the dates don't go back? thank you.
 
Interview Notice !

Well, USCIS just surprised us with an interview notice, for 07/31/06. My wife had the FP appointment on 06/02. It would be a really pleasant surprise to get the green card so fast!
