Hello,

wondering you could suggest....

I filed my 485 with one Coy in May'02 and joined another Coy in April'03 . Now ex employer is saying he would send a letter to INS (kind of revoking my I140, right?). That guy is asking money for not to do that. Lawyer also such a stupid guy..

I guess I don't have a choice other than below
* Change the lawyer. and file AC21 with that lawyer.

What if I change the lawyer? any problems like getting delayed or transfered. or >>>????

Since your I-140 is approved and I-485 is pending beyond 180
days I think you are safe.This was discussed in several threads
in 2nd week of July here.According what I learned from posts
here changing lawyer should not delay your process.

PAYMENT FOR WHAT ? DO NOT PAY ANYTHING. NOT EVEN A SINGLE CENT.

Since it has allready been more than a year since ur 485 has been filed you have no reason to worry. 485 is not for employer but for ur change of status. With the recent clarification of the 140 revokation issued by BCIS you are absolutely safe. ex-employer cannot revoke 140 after 6 months. Change the lawyer and start working with whom u are comfortable. The new lawyer has to send new G-28 form to BCIS. Ask ur old attorney to transfer paper work to new attorney .if there is no response then ask ur new attorney to send a politely worded request to old attorney asking for transfer of all the paperwork.Most of the attorney's will oblige.

Try to document any extortion bids. Get emails/letters from lawyer/employer.

Once you get your greencard you can probably sue them for extortion and blackmail. It might be risky by sick people like that shouldnt go unnoticed. Document EVERYTHING!
 
Try to document everything.
Tell him that you know that law and immigration process. And also tell him that he can do what ever he wants.
He cannot revoke your I140 after 6 months have passed.
Talk to attorney and confirm and transfer your file to new attorney.

Then after everything is done, bring him to court of justice. . .

Although there was a memo about the 180 days rule, we still heard some bad news about I-485 got denied because of the revoke of I140. If he had trouble because of this, it would be a big pain although he still might have chance to resolve it. Therefore, the best way is still to negociate with the old employer and try to find a good deal. The whole GC process has already been so unpredictable, I believe you never want to put some negtive factors on it. That's only my personal opinion though, please think about it carefully before doing anything!
