**What exactly do they check in CP**

Hi! Before the CP, there is the LCA and the I-140, right?

1). Does the interviewing consular compare the education and experince that we put in LCA with that of DS230-I.

In my case my MBA was not mentioned in my LCA, but it is mentioned in my DS230-I.

2). The salary - does it have to be same in the LCA, I-140 and the employment letter. What if it is different(higher)?

3). Also, I read that our documents must be in some kind of order when we go for the interview?

I had my CP done on 23rd and this was my experience:

1. They did not ask for any edu. certifications etc.
2. If your current salary is higher than LCA...NO PROBS !
3. Depends on your consulate...like for Chennai they had an order: I asked the security guy on the day of the interview and he gave us a sheet that had the order..we just arranged it in that. But generally it seems like your ds-230 pt1,2 , then your marriage cert if any, your bc, emp. letter, salary stubs, bank statements, 9003 in that order.

1. Labor certification process confirms that the employer was unable to recruit an American worker with specified skills and that the applicant possesses these skills. For labor certification, the skill set (education + experience) is carefully crafted to demonstrate that there is no similarly qualified American worker. Your MBA probably didn’t contribute to the skill set that your employer was targeting, so it wasn’t included. DS 230 requires you to list your entire education and job history, so your MBA needs to be included in DS 230. There are several examples of PhDs in EB2, whose labor certification didn’t mention the PhD, but used MS instead.

The consular processing interview is quite brief, and it is impossible to verify any supporting documentation. However, by signing the forms (DS 230 pt. II ) and taking the oath, you are affirming before the consular officer that the information supplied in the documents is true and that you have not falsified any information. Lying to a federal officer is a felony, and can result in deportation.

2. Ideally, salary indicated on the employment letter should not be less than what was mentioned on the labor certification (ETA 750) forms. If it is lower, it should be at least greater than the prevailing wage for that job.

3. Order of documents: in most consulates, there is a pre-interview ritual where the office staff reviews all material for completion, etc. This has no bearing on the actual interview. If your documents are not in order, you may end up spending more time in the pre-interview ritual, and may even be chided by the staff.
