What does Specter's Bill mean for advanced degree holders.

Per specter's bill, do the advanced degree (M.S. or Phd from USA) holders --
1. are exempt from visa/gc number limits?
2. do they need to file for labor?
3. what is the definition of 3years worth of work experience? Work ex as of date of filing? Does the experience on OPT count?
4. can they apply for 140 and 485 concurrently?

Would like to start a discussion on these topics. From what I understand, this bill is really going to be beneficial to all oversubscribed countries. Advanced degree holders with requisite work experience currently account for atleast 40% of the total pending GC applications.

I think you definitely would need to get a LC. This is for the condition that no US worker is available for your JOB. The numerical limit of visa numbers will not apply for eligible candidates.

Im confused about the starting period of the 3 year clause too. Does that include time worked on the OPT??

Folks, you guys are "putting the cart before the Horse".
Specter's bill will be passed in the Senate by a majority but will be dead on Arrival (DOA) at Congress.
None of these liberal immigration bills will be passed by Congress. I mean the Congressman are evn telling President Bush to FO on this issue.
Main issue is influencing Congress not senate, otherwise whatever senate is passing is irrelevant.
 
I beg to differ. It is worth discussing this bill now and try to provide feedback to the senator about bill at this point, before it fails or passes at the Senate or House floor. The former is more likely though.

Specter is an influential senator. What surprises me is that after taking a supreme defeat in the S.1932 bill, he came back with the idea of increasing the EB numbers to 290K/year on a permanent basis and not counting spouses. Unlikely that will pass.

Why not just ask more reasonable remedies, such as increasing the visas to larger numbers on a temporary basis, for the next two years to take us out of this mess of shortage of visa numbers ?
