12/21/2006: Hats Off to Mr. Aytes and Other USCIS Leaders

The USCIS gave a fantastic gift to the employment-based immigrant community yesterday. Readers may know what this reporter is talking about here. It is the Aytes Memorandum on H and L issues. This is a totally unexpected gift from sky! We encourage the community and immigrants to send "thank you" to this fine gentleman and other leaders of USCIS at this Holiday season!

All I have to do now is find an employer and convince him to give offer 10 months in advance.... Piece of cake :D :D
 
Well, that's pretty good news, is it not? :)

If you read the memorandum properly, you would see what actually is a good news. Which is.....

If your spouse has been on H1 for 2 years, and then on H4 for 4 years, there was no way he/she could have got the remaining 4 years on H1 until they had been out of the USA for a year.

however, in view of the clarification in this memorandum, the spouse can get an H1 for the remaining 4 years WITHOUT being subject to the cap. That, for some folks, could very well be a good news, since once they find an employer to sponsor them, they could start working once the H1 is approved.

I agree with felix :) ..it is like saying there is cake on the top shelf ..but you wont get it..unless you are able to find an employer who can sponsor you 10 months in advance before the quota gets over. ofcourse in most cases the employer will make you pay for the cake.

Nope, it does not have anything regarding 7th yr extn. Your spouse could get 6 yrs on H1 if she has not had an H1 before, true.

What if Labor is approved more than 365 days ago (not substitution) but I-140 was never submitted?
