What are they doing with my case?

My lawyer got REF on my 140, 2 weeks ago and he sent the response back last week. 140 LUD has been changing to 20th,21st,22nd and today 25th. But nothing happened. Is it common? Anything can I expect soon? Thanks.

My case went very similar. The LUD changed 4-5 days everyday after they rvcd. the response. Then it stopped changing for 4-5 days. Then it was approved. Good luck.

I did get a copy of the approval notice. It does have same language saying that the "person for whom you are petitioning is not eligible to file adjustment of status ...". I have sent my attorney an e-mail asking for clarification/his opinion. I will update here when I get a response. I strongly feel that this is their standard language when they approve a 140 with PD not current. It should not effect concurrently applied applications when PDs were current. Our 485s maybe in suspension till our PD becomes current and till then we can avail all the advantages of pending 485 (i.e., AP & EAD renewals).

Here is what my attorney replied with to my e-mail.

"If you had not filed for adjustment of status, you would not be able to because of the visa regression. Since you already filed Form I-485, you're OK".

I think this makes sense.

Some people see LUDs for several days in a row, then maybe a week of no updates and then approval. I'd be willing to bet money that you will receive an approval email next week.

That's the most positive attitude cfiler. We need to have more people with such attitude.

skp19722003, could you please let me know which officer processed your case? This is the way to find out: There is a code in RFE letter at the every end, below the signature, which represents each individual officer. I sent out my response to RFE on 4/19/2005, so far I have not heard anything. I hope I have the same officer as you.
 
What's the code on yours? There are a couple of codes in my RFE and I'm not sure which one is the right one.

cfiler, I will post it after I get back home. Now I only remember it is like:

(some letters) / (some letters) / (maybe some numbers, I am not sure)
 
Yes, that's the format on mine. Which one of those sets of numbers is the officer code?

NSC/ (3 letters and 3 numbers) / (3 letters and 3 numbers)
