I am considering changing jobs within my company.
My question is, if I get a RFE about my employment one day, what documents do I have to provide?
What I am afraid of is a request of job discription becasue no two jobs are identical.

Anybody have experience, please help

I may change location

w8nc:

If i change job, I may have to relocate from one town to another.
My homeaddress may have to change accordingly.

But on the other hand, since I still work for the same company, same HR, same lawyer, I am not sure I have to report the address changes to BCIS.

BCIS requries reporting address change no matter job change or not.

Hi,
Actually BCIS requries reporting address change, no matter your job changes or not.

Address change should be reported

Even after you get your GC you are required to keep BCIS current with your home address.

thanks

Thanks.
Suppose I change my job within my company, change my work and home address, report it to BCIS. Then, BCIS issue a RFE for my case, What will I be asked to provide? will a new job description needed?

from what i understand along with my own employment based rfe experience, the rfe specifically wants to know if there has been any changes to the stipulants of your labor certification. i.e. are you still employed at a SIMILAR job, not necessarily the same employer.

Therefore it is always wise to specify the job description in your employment letter and add the extra line that it matches the job description for which labor certification was approved. Otherwise, the INS has the right to investigate further or deny the case since the basic principle of GC has changed and may ask you to file new labor for new GC.

speak to your lawyer as well as your employer whether or not, just for INS purposes, they can give you a letter stating old job description should the need arises.

thank you

Thank you very much.
In my case, I didn't do LC since I applied through outstanding researcher. Would BCIS still possibely asking me for a job description for my new assignment?

similar situation

I am currently in a similar situation of possible job change. location change in the same company. I have spoken to my lawyer and here are his comments.

a) I need to have a clear understanding with in the company that they will take me back on the same job, same location (old) after the 485 is approved. This may be for a month, but has to be done.

b) If I / we (me and company) can prove that, I am moving only temporarily for a project/ assignment it is better. May be a letter in advance will help.

c) Address change has to be informed any way or keep the existing house.

d) Even if, not get RFE, new address in new town may be an issue at the time of passport stamping and new FP for green card issuing, hence plan every thing in advance.

Start with your lawyer with a thought process, what happens when approved and then back it up to the present date. This way several action items will open up and each will have to be dealt with at appropriate time. Some of them like taking a letter of assurance from company that you will be given a similar job on the same location has to happen today. You may also consider changing your address to a new one (friend, relative, work place) in existing town and also maintain your existing driving licence till the approval.

Do, I make sense?

thank you very much

Thank you very much. The information you provided is very informative.

I guess it won't be wise to go do something else unless you can make sure in advance that you can always come back to the status you are in when you first file your 485.

The golden rule will always be: try to make no change until you have physically receive the card.
