What Are Priority Dates?

thanks for the help she came in on K-1 visa i was wondering about AOS
our DO is Miami and agirl from tampa got her interview long before the processing times infact the processing times were before she applied and she got interview tampa and miami are similar i realize thaese dates are off and then somebody mentioned priority dates my wife is here we need AOS interview info thanks. i amnew to this but this is great forum and people are awesome like you!1

thanks! Yes, it can be very confusing. I know Miami is a little slow, but you are a USC so it's not so bad. Good luck!

no, you gotta look at processing dates, not priority! In your case it's the Miami DO. But I read some people saying that those dates are not very accurate.

do you see anything missing from my wifes signature she came in on I-129f
does she need to file i-130 the immigration officers said the I-129f was ok
the are both petitions,

Hi eric v, Here is some information for you if you havent already read this,
http://uscis.gov/graphics/howdoi/hdifiance.htm
http://uscis.gov/graphics/howdoi/fiance.htm
http://uscis.gov/graphics/formsfee/forms/i-129f.htm
http://uscis.gov/graphics/howdoi/fianceapp.htm

pls do a thorough search of this forum and USCIS site and if you have questions after that, anyone of us here would be glad to help you out.

to answer your original questions:
Priority date is the date an immigrant visa petition is filed with USCIS. The priority date determines your place in line in an immigrant preference category. Since in your case, the applicant happens to be the immediate relative of a USC, there is no waiting in line as the prority date is always current. There is an immigrant visa immediately available for this category. Processing dates govern the time a DO or SC takes to process your application.
Good Luck!

You dont need to file I-130 as you already filed I-129F. When fiing I-485 you would have selected choice C from section 2. Since you have already filed the I-485 package, AOS process has already started. I hope this answers al your questions.

thanks

thanks i had an attourney try to tell me, or i should say, try to charge me ,$2000 grand to re-submit my wifes papers, and said i had forgoten to apply for I-130 which is a petition but since my wife had come in on I-129f that was the original petition , why would we need another petition i asked myself? Thanks! Ari now that we await the AOS here in Miami w/a big backlog I noticed that RAREGOLD "user name" already got her AOS interview and approval and Tampa is working on about the same processing dates, i am confused because Miami is processing Jan 05 and Tampa April 05 for the I-485, before the Notice Date of I-485, so I thought when the forum talked about priority it was for AOS but as I understand its a priority date set from the Time of Visa K-1 , the visa has expired and as you can see from what i tried to write in signature that we e-filed for AP but i guess that was a waste of money because we probably would not get back in? im sorry if i sound confused I just hope we get an interview maybe sometime this summer
really thanks for your help and kindness I can tell you have an excellent grasp on this system ,bless you

i am looking at the I-797 approval for the I-129f and in the box that says priority date it is blank, she is here and we filed the I-485 August 5,2005
nearly 174 days after the I-94 class or K-1 visa expired because we had a child and there wetre some complications after the birth, she arrived in Miami
pregnant and almost was not allowed to fly, then while she was here pregnant still we could not get her the Imunizations for the Civil surgeon part of the medical exam so we waited a while almost 180 days which would cause problem for AP? we sent AP 3/15/2006 probably a mistake and waste of money?

PD is blank because it is always current for the immediate relatives of a USC. There is nothing to worry about. As the spouse of a USC, overstay would be forgiven but avoid the AP route totally as that would trigger the 3/10 year bar upon using AP to re-enter US.
