what are options? Is PERM an option?

Hi,

My H1-B 6 year period is expiring in February 2005. Labor certification has not been filed yet from the current employer. My husband's H1-B is also expiring at the same time, however his labor certification has been filed before 365 days in DE DOL. I am looking for options that anyone can suggest with my current situation. I have heard that PERM is coming late October. Has anyone got any more information on this PERM and how this will help in my case. Can someone also provide me details around how PERM works. Any other suggestions which will help me in my case is very much appreciated.

I would wait until May 23 - This is when one of two things will happen:

- PERM will get approved and therefore begin operating around Oct 1st
-> See if PERM regulations allow you to submit under PERM
-------> If yes, see if applying under RIR now would get you an approval by Oct 2004.
---------------------> If yes, then go ahead and apply under RIR
---------------------> If no, wait for PERM and apply then
-------> If no, then apply for RIR now.

- PERM will not get approved and get delayed one more time
-> Submit RIR application


PERM will approve (hopefully) your application in 21 days but it is likely to be more restrictive than current RIR.
