Hi folks,

Here is my situation. PERM was filed electronically on 01/13/2009. My 6th year on H-1B expires on 06/11/2009. I have been out of the US for 73 days while on H-1B. So, I get to recapture that time, which would give me time til like 08/23/09. Can I stay till 08/23/09 before I leave US. Are there other options available for me? My lawyer had told me that I should leave by July 1st. Is it safe to leave the US and get back in with a B-2. Please let me know!

best option

you can leave the country now, work from outside for two months, and come back before 11 june , then recapture the time from previous and this two month stay outside US, that will extend your visa to around 1nov. then between june and november, make another two month trip where you work from outside, and then come back before 1nov and recapture time - that will take you beyond 1/13/2010 at which point you can get 1 year extension.

not very good option but the only one that i can know of.

my plan is to just wait til july 1st and then leave for about 3/4 months. if i get my labor approved by end of august/september, i can also get the 3 year extension after gettin I-140 approved, right?
