What are AC21 Requirements?

Hi

I work for a company which seems to be getting financially unstable, In other words it may or may not go out of business, In order to save my GC I would have to change my job and get a better one. i would like to know

1) what if the salaray requirements does not meet
2) Do i have to inform the CIS regarding the change in Job.
3) Does the company have to be financially large as the company i am working for now?

My current employer is a good man and would continue the process if i ask him to, But should I hang on to the same company i am working for or should i jump

Please give me some advice.

-----------Salary does not matter as long as it is within the neighbourhood of what was stated in LC.

2) Do i have to inform the CIS regarding the change in Job.
-----------Yes. It is better if you send them a letter stating your intention to join a new employer who can give you a letter confirming that the position is for permanent one( Better have the same or similar job duties as the old one )ie AC21 letter. You can get the template for the same in any of the forums......

3) Does the company have to be financially large as the company i am working for now?
----------Find a company which has been around for a pretty reasonable amount of time has good financial background. Don't join a startup.

( PS:: I am assuming that your I-140 is approved )

The keyword is same or similar. USCIS knows that different companies have different positions/titles and are considerate :) . As long as your duties are don't change dramatically it ok.

Is your 140 approved? If so, you're cool since you've completed 180 days after filing 485. Since you have cordial relations with your current employer I guess they will not revoke your 140, and even if they did it's not going to affect your 485 if it's approved. New salary does not need to match the LC salary. Make sure that the new job description is same or similar. Job title also doesn't matter all that much. Company size and geographical location are not relevant either.
 
salary should be atleast around 95% of the prevailing wage mentioned in labor by DOL. Check to make sure that this is met. If you fall short by say 20% points on this, then it may create a lot of problems for you down the line.

Not true. I've seen cases being approved where the salary difference was more than 20%.
 
Yes There are lot of cases getting approved like that. But tomorrow Some adjudicator may say he wants the Labor specified wages. So It is better to keep that wages in the explainable range.

Yes lot of cases get approved but if you get an RFE, then you may not be in their position. Dont try to meet the lowest bar man ... try to meet the highest bar if you can help it ...

Hi, Thankyou for all the replies, I feel more relieved now. I would find something atleast equal to the labor wages if I can hopefully,
By the way my 140 got approved on the date I specified in my first message . It's good to be a part of this immigration community. I pray to god that everyone should get approved as early as they wish for. :)
