what about marriage before GC?

Here is the question, guys. If i am going to get married to USC now while having pending final approval( having recommended letter for 9 months :mad: ), what is going to happen to my asylum case and all paperwork,already submitted, what can i benefit from the marriage on this stage or what can i lose? Or should i wait?

If you have a USC spouse, let him apply ASAP. Why do you care for your asylum application? Once he/she applies for you, you will get a 2 year conditional gc and then a permanent GC after you prove that your marriage is true...After 5 years from the date on your GC, you can apply for US Citizenship.

were you in illegal status or you came to this country illegaly? If thats the case stick with your asylum GC because you will be inadmissible.

I came to the US on J1 visa and applied for asylum within 1 year from the date I got here.Is that considered to be legal?

Yes you are ok. Apply asap...YOu are waisting time waiting for the final approval. Your case is clean and simple.

I just wasnt sure...and still wondering whats going to happen to my asylum? should i hire a lawer to close my case or it cannot be closed now?Will i remain e refugee or my marriage will cross that out?

Kate, the main thing is maintaining legal status in this country. When you were J-1 and applied for asylum, you automatically are legal. Lets say you get crazy and get married tomomrow in Las Vegas and your spouse files a I-131, it doesn't matter what happens to your final asylum approval.

Just hire a lawyer but i think its pretty straightforward in your case. Maybe our unoffical board lawyer--->Thankful can chime in on this issue as well.

:o the problem is that J1 got expired during my stay here but application for asylum filled out within 1 year of arrival. Still legal? :o

Staying illegal is kind of forgiven when you get married to a US citizen. I know this because it happened to someone I know(and from your description you have not been in illegal status, so do not worry).......Plus one more thing; after you are granted GC you can apply for citizenship not 5 but three years later( that is if you stay married to that USC). So forget getting GC through asylum, do it through marriage, which is faster way to citizenship and no money spent on RTD's or reentry permits after you get your GC and no paranoia about visiting COP's.

Go ahead, marry your fiancee and forget the whole asylum deal like a bad dream. As long as your asylum case is pending you are perfectly legal. As soon as you are married, file one-step petition and your conditional GC will be backdated to the date of marriage. Two years later you file a petion to remove conditional status and another nine months later you can apply for citizenship, if you wish - spouses of USC's are eligible to apply 2 years and 9 months from the date on their GC's. This marriage will put you in a different category and much better positoin. Good luck with everything! ;)

Maybe I am wrong so need to check on this. You are granted a GC for 2 years conditonally and when conditions are removed, you can apply for u.s citizenship(3). BUt you still wait 5 years after your gc since 2 years to wait for conditions on your gc.
