Anyone who has current PD and I-485 RD in 2004 then they are getting approved. If your I-485 RD is before Sep 2003 then you are stuck again. No approvals. Seems like second Name Check is being initiated. So perhaps there is a life time for Name Check and it is expiring for people with earlier RD.

So now that means, who filed later are the lucky ones.

It looks like many people from India applied in 2004 with EB3 category. From Jan 2005 dates are retrogressed for India EB3. Very few people are applied in 2005 with EB3 India category. Do not know how long I have to wait to see the approvals
 
I hope that your theory is wrong. On one of the foru,s I found some USCIS docs regarding namecheck. It says that the namecheck response is indefinite for certain application that it was initiated for. It is definite if used for multiple applicationas an then expires in 15 months...

Name check absolutely a trick they are playing. I heard of this from Immigration Officer. In my case it was reverse. My first name check is pending from May 2006 and they did another one in March 2007 and it is clear.

But all this is BS.

If you havenot already done these things, I would recomend you to Work with Congressman/Senator/USCIS ombudsman.
First Lady/Vice President/President might help you tooooooooo.

Sit in the week end prepare all the papers and fax them or mail them.

You should get u r approval in few weeks as they purely going by the 485 RD which u rs is too old.
 
my take is along with PD/RD, even state is playing the part, i haven't came acrros any NJ approvals, most of them are from ATL
